SCOPE AND PURPOSE OF THE GENERAL CONDITIONS

This document is intended to regulate the terms and conditions that will govern the use of the website nora.serhouses.pt (hereinafter, website). Browsing this website implies acceptance of this document.

The website is owned by ART – Therapeutic Responses Association, headquartered in Quinta Horta da Nora,
7780-139 Castro Verde, with NIPC 504443313, hereinafter referred to as “serhouses”.

Serhouses reserves the right to freely change this pre-contractual information in order to adapt it to applicable legislation, without the need for prior notice.

Access to the serhouses website is free and does not require prior subscription or user registration.

RESPONSABILITIES

Data and information queries carried out within the scope of this service are presumed to have been carried out by the user, with serhouses declining any responsibility arising from abusive or fraudulent use of the information obtained.

Serhouses will not be liable for any losses or damages caused by abusive use of the service that are not directly attributable to it as a result of intent or gross negligence.

Serhouses is not responsible for losses or damages arising from non-compliance or defective performance of the service when this is not directly or indirectly attributable to it as a result of willful misconduct or gross negligence, and is not responsible in particular for (i) errors, omissions or other inaccuracies relating to the information made available through the service, (ii) damages caused by the fault of the user or third parties, including violations of intellectual property, (iii) for non-compliance or defective performance resulting from compliance with court decisions or administrative authorities or (iv) for non-compliance or defective performance resulting from the occurrence of force majeure situations, that is, situations of an extraordinary or unforeseeable nature, external to Serhouses and which cannot be controlled by it, such as fires, power outages, explosions, wars, riots, civil unrest, government decisions, strikes, earthquakes, floods or other natural disasters or other situations beyond Serhouses’ control that prevent or impair the fulfillment of the obligations assumed.

USER OBLIGATIONS

The user undertakes to:

  • Provide correct personal data and addresses;
  • Do not use false identities.

The user accepts that serhouses cannot, in any way, be held liable for any damage, including, but not limited to, damage for loss of profits, data, content or any other losses (even if previously advised by the user about the possibility of such damages occurring), resulting from:

  • The use or inability to use the service;
  • The difficulty of obtaining any substitute goods/services;
  • From unauthorized access or modification of personal databases.

In the event that the consumer violates any of these obligations, serhouses reserves the right to cancel the provision of any services made available simultaneously by serhouses to the same user; and also, not allow future user access to any services made available by serhouses.

PRIVACY AND PROTECTION OF PERSONAL DATA

Serhouses guarantees the confidentiality of all data provided by users.

The data provided in the contact form as being mandatory are essential for the provision of the service by serhouses. The omission or inaccuracy of data provided by the user is their sole and entire responsibility and may result in serhouses refusing to provide the service.

The user’s personal data will be processed and stored electronically and are intended for use by serhouses within the scope of the contractual and/or commercial relationship with the user.

Under applicable legislation, the user is guaranteed, without additional charges, the right to access, rectify and update their personal data, directly or upon written request, as well as the right to object to the use of said data for the purposes set out in the previous number, and for this purpose they must contact the person responsible for processing the personal data, by email at carla.silva@art.pt

CUSTOMER REGISTRATION ON THE WEBSITE

Mere access to the website is not subject to registration.

The user is responsible for the veracity of the data provided, whether at the time of registration or for contact forms, as well as for updating them.

All content entered into the user’s account, as well as all activity that occurs therein, is the user’s responsibility, and serhouses has no obligation to monitor the content or the (non)compliance with any responsibilities of the user.

Serhouses does not have access to or knowledge of the password defined by the user for the purpose of accessing the website, and it is the user’s responsibility to ensure the confidentiality of the password and guarantee its safekeeping and proper use, as well as comply with good practices regarding the security of their account. As such, serhouses cannot be held responsible for losses arising from the loss or misuse of the password defined by the user.

INTELLECTUAL PROPERTY

The website is registered and the service provided by the website itself is the responsibility of serhouses.

The user acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.

The user acknowledges that any content contained in the advertising, highlighting, promotion or mention of any sponsor or advertiser is protected by laws relating to copyright and related rights, by laws relating to industrial property and other property protection laws, and therefore any use of such content may only occur under the express authorization of the respective owners.

The user undertakes to fully respect the rights referred to in the previous paragraph, refraining from carrying out any acts that may violate the law or said rights, such as the reproduction, commercialization, transmission or making available to the public of such content or any other unauthorized acts that have the same content as their object.

SERVICE SECURITY CONDITIONS

The user undertakes to observe all applicable legal provisions, in particular, not to practice or encourage the practice of illegal acts or acts that are offensive to good customs, such as the indiscriminate sending of unsolicited communications (spamming) in disagreement with the provisions of the legislation applicable to the processing of personal data and advertising communications through automatic calling devices, and must also observe the rules for using the service, under penalty of serhouses suspending or deactivating the services under the terms provided.

The user expressly acknowledges and accepts that the IP network constitutes a public electronic communications network susceptible to use by multiple users and, as such, subject to IT overloads, so that serhouses does not guarantee the provision of the service without interruptions, loss of information or delays.

Serhouses also does not guarantee the provision of the service in situations of unpredictable overload of the systems on which it is supported or force majeure (situations of an extraordinary or unpredictable nature, external to Serhouses and which cannot be controlled by it).

In the event of interruption of the provision of the service due to unforeseeable overload of the systems on which it is supported, serhouses undertakes to regularize its operation as soon as possible.

COMMUNICATIONS

Whenever serhouses deems it necessary or convenient to optimize the browsing experience and/or improve connectivity conditions, it may remotely reformulate the network configurations.

Without prejudice to the provisions of the following numbers, and taking into account the innovative nature of the service and the technological developments to which it may be subject, serhouses may change its technical configurations whenever this proves convenient to adapt it to possible technological developments.

Serhouses does not guarantee the user that any upgrades or improvements will be made to the service. Some upgrades or features may only be available upon payment by the user and/or subscription by the same.

APPLICABLE LAW AND DISPUTE RESOLUTION

The contract is governed by Portuguese law.

The consumer may complain to serhouses about acts and omissions that violate the legal provisions applicable to the acquisition of goods.

ARBITRATION AND RAL CENTER (ALTERNATIVE RESOLUTION OF CONSUMER DISPUTES)

Alternative dispute resolution is the possibility that all consumers have at their disposal to resort to official entities that help them resolve or provide guidance on any conflict, before opening litigation proceedings in court.
